Wage-and-Hour Claims

Employers violate wage law in many ways. If any of these situations applies to you, you may be owed unpaid wages and overtime.

Salary Misclassification

Many employers avoid paying overtime by classifying employees as exempt because they receive a salary. Being paid a salary does not mean you are not owed overtime.

Independent Contractor Misclassification

Workers may be classified as independent contractors to avoid paying wages and benefits owed to employees. Employers cannot avoid wage obligations through misclassification.

Regular Rate Violations

Some employers pay overtime at a rate lower than required by law by improperly excluding certain pay from the overtime calculation.

Off-the-Clock Work

Employers must pay for all time worked, including time spent preparing for a shift, traveling between job sites, or completing required training.

Time Shaving

Employers may not alter recorded time entries or fail to pay for all recorded time worked in order to reduce wages owed to employees.

Meal and Rest Breaks

Employees who are required to work through breaks, or whose meal breaks are automatically deducted without being taken, may be owed additional wages.

Delayed Wages

The law requires that employees be paid on time. Employers who fail to pay wages within the time required by state or federal law may owe additional damages.

Minimum Wage Violations

Some employers fail to pay the minimum wage required under federal or state law for all hours worked, including through unlawful tip credits or deductions.
